Virtual Room Los Angeles asks clients participating in a virtual reality gaming experience to sign waivers because when people are running around a room wearing headsets there’s an assumption of inherent risks and dangers, said Chip Broyles, Client Success Manager for WaiverSign. “This is one of our busiest clients with more than 4,000 waivers signed annually.”

Stumpy’s Hatchet House, America’s first indoor hatchet-throwing venue headquartered in New Jersey is a franchise that plans in the near future to open a dozen or more locations nationwide. The company was formed when two friends got together to chop wood, observing that people would pay to do this.

A recently added feature of WaiverSign can organize waivers for specific events. This attracted Bethany Church of Broken Arrow, OK, that hosts summer camps and mission trips. “We do a ton of Christian-themed camps and churches. These clients like how easy WaiverSign is to use – and the price,” said Jeremy Jensen of WaiverSign. “They all have the same need of efficiently protecting themselves and making it easier for their folks to get involved in the activities they signed up for. Parents and guardians can easily sign the waivers on any web-enabled mobile device. Plus, there’s an optional language feature; people can easily switch to Spanish.”

Lawyers like the fact that through a digital program people have access to documents to read carefully and to sign before they arrive at an activity destination so there’s no last-minute signing situation. The signed document is also delivered with the signer’s email address. The old paper waivers didn’t do that.

There’s no end in sight for where WaiverSign can be useful, noted Broyles. “It can cover any program that may create potential distress or harm the body. This includes yoga and massage businesses.”

Initially insurance companies recommended WaiverSign for such risk activities as rafting and zip line enterprises. Risk management attorneys helped create the initial version of WaiverSign. “Now our clients are contributing their ideas that help us make the product better and better,” said Broyles.

SALT LAKE CITY, June 18, 2018 – Before jumping off a bridge, the outfitters facilitating the bungee jump may ask you to sign a waiver – on an electronic device.

Waivers aren’t new. But the idea of using electronic waivers – instead of paper – is only a few years old. Paper, it seems, is becoming an anachronism in today’s litigious world.

Millions of adventure seekers from around the world have used WaiverSign before participating in high-adventure activities like zip lining across a canyon or rafting through rapids in the bottom of the Grand Canyon.

“In fact, riding these Class III to V rapids on the Colorado River through the canyon is exactly where WaiverSign got its start,” he said. He explained that sister company Western River Expeditions since 1961 has been delighting their guests with bucket-list experiences of seeing the Grand Canyon -- not from lofty points high on the rim, but instead right down in the heart of the canyon itself, riding the waves of the river as it continues to carve its way through the mile-deep chasm.

Like virtually all adventure tour operators around the planet, Western River Expeditions requires all of their guests to sign an Acknowledgement of Risk form prior to participation.

“For years this process was handled on paper,” says Brian Merrill, CEO of Western River Expeditions. “It was a tedious and cumbersome process. On top of that, half the time we couldn’t even read the personal information that the guests were sharing with us because of poor penmanship, so this required additional phone calls or other conversations to clarify. This ultimately meant more time, money and effort.”

In June of 2000, the United States Congress enacted the Electronic Signatures in Global and National Commerce Act (ESIGN), which ensured the validity and legal effect of contracts entered into electronically. The Importance of an Optimized Website - Western River Expeditions’ Tuned-up Site Results in a 56 Percent Revenue Increase in First 90 Days

Dudes Waive before Riding: Western Guest Ranches Employ Electronic Waivers Prior to Participation in Activities

SALT LAKE CITY, UT, April 22, 2015 – Member ranches of the national Dude Ranchers’ Association perked up their ears at a recent gathering where they enjoyed a presentation about a new-fangled digital liability release process called WaiverSign that goes a long way to eliminating human error and paperwork.

“The response was overwhelming,” said presenter Brandon Lake of WaiverSign headquartered in Salt Lake City. “These folks would rather be out riding the range and providing incredible guest service than filing papers, and that’s where WaiverSign comes in.” This is a paperless liability waiver application that allows guests to electronically a sign a waiver even before they arrive at their dude ranch for vacation.

Since the recent conference, Lake said more than a dozen ranches have signed on to integrate WaiverSign (http://waiversign.com/) into their busy lives. Some ranchers who had been using the new system for awhile advocated for WaiverSign at the conference. 

Laurence Kaplan who owns Red Reflet Guest Ranch in Ten Sleep, WY, said the waivers are signed electronically before guests arrive. “The process is just so simple and the waivers are not lost in the filing stack! The experience of moving to paperless has been positive, simple and painless! The KISS principle has been applied and works well.” Based on this satisfaction and the fact that WaiverSign helps the business look even more professional, Kaplan is recommending the system to other colleagues.

The President of the association, Douglas Hare, who is general manager of The Red Rock Ranch near Jackson Hole, WY, said that prior to using WaiverSign he used printed waivers that people signed when they checked in. Hare states that he “often had to track them down to get them to sign at some later point. This created a liability issue.”

Hare has now used WaiverSign for two years. “The system has streamlined office time immensely, being the small business that we are. My office time is unfortunately too much when I should really be focusing on guest services. WaiverSign has made my life easier and my time in the office less. And I am more secure now that the waivers are signed before guests show up.”

He said that he did confer with his legal advisor before making the switch from paper to digital. They’ve thought of everything.” He said the digital waiver can even be taken on an iPad in a ranch vehicle for initial guest pickups. “Transportation is covered before they get in. On the edge of Grand Teton National Park is Moose Head Ranch. Louise Davenport, proprietor, has had three summers with WaiverSign under her belt. “Horrible” is how she described the paper process before WaiverSign.

In Seattle, Mona McPhee of McPhee Law Office said that some 50 percent of her clients are tour operators.

“When I work with them, quite a bit of what I do relates to risk shifting, so we talk about waivers. Many of them don't collect waivers in the best manner possible.  I am aware of several technological solutions to that and WaiverSign is one of them,” McPhee said. “From what I understand of the product, it implements what I would recommend as best practices for my tour operators.”

In regard to legal standing, “It would be supported in every court that I’m aware of and is something I have recommended to my clients,” McPhee added.
