WhirlyBall and Big Shots Basketball now count among the many satisfied WaiverSign clients who during the pandemic are especially appreciative of the paperless efficiencies and no contact procedures that come with this leading digital waiver solution.
The sports company known as Big Shots began using WaiverSign in 2020.
“This is one of the best things we have done in 16 years of running Big Shots,” says Jeffrey Schneider, CEO. “Our numbers have been unbelievable. At every event when people walk into a gym they are asked to present a waiver. If they leave the venue and come back, they show their waiver on their phones again. Everything is 100 percent electronic.”
“We work to provide the very best youth basketball events and WaiverSign has become a part of these events,” he says.

Being cooped up by the pandemic may mean copping out on exercise. But spring brings the urge to take our bodies to task once again. A cadre of personal trainers stands ready to help with corporeal renovations.
For example, a team of seven personal trainers serves up to 40 clients daily at Wattage, a personal training facility in Chicago. Manager Maria Candia explains that training here is appointment-based, semi-private, or one-on-one.
“People want to move for an hour under the guidance of an experienced and certified trainer, someone who knows exactly what to do to help, even when outside of the gym,” she says.
Along with so many other businesses, Wattage was closed for a period of time in 2020, re-opening in June after establishing COVID-19 protocols to protect clients and staff. SALT LAKE CITY, Feb. 24, 2021 – Ned Gilardino lives in Colorado. He’s a retired teacher enjoying one of his retirement assets, his home with mountain views and an 800-square-foot swimming pool. Last summer he realized that with the pandemic-driven closures of public swimming pools his own backyard amenity might be turned to profit. He arranged through Swimply.com to list his pool as available for single-party rent by the hour.
“People paid me, brought me wine to thank me, and were so grateful they had some place to go. The need is there,” he said.
One of his clients, an attorney, asked: “Where’s the waiver?” This prompted Gilardino’s search for a convenient, paper-free service that would protect him and his house. One of Shannon’s goals in securing WaiverSign is to minimize services that involve frequent touching of paper and pen.

Broyles is Vice President of Client Success for RESMARK Systems in Salt Lake City, Utah. Along with much of the broader hospitality industry, many tour and activity operators throughout the world have been in freefall this year.
“We are preparing for the inevitable return in the coming months. Things will eventually return to pre-pandemic levels. We learned a lot with this pandemic about how to rethink tours, rethink social spacing and how to accommodate what’s going on in the world. Everything is not about COVID-19 but is a reality of what has affected tours and activities,” says Broyles.
Among the issues facing tour operators this year were:
● Cancelled reservations including an almost total drop-off in international travel. Broyles says this is slowly coming back. ● An unexpected demand on some tour operators to meet domestic requests in June, July and August. “A lot of people were pent up and wanted to get out. Those tour operators who could accommodate found themselves extremely busy. Some had more business than they could handle because of limited staff. They might be open but they might not have all of the guides who would be comfortable working in these times,” says Broyles. ● Learning to push forward, plan ahead, clean house and get ready to be busy again. “We have no idea when this will happen. Things are happening slowly. Certain islands in the Caribbean are starting to open up,” he says. “Now is still a great time to look at tightening things up. So often, tour operators have too many offerings, too many activities and tours.” |
Broyles and his team are providing counsel on these and other issues to existing RESMARK clients and to others who aren’t yet on board.
“We’re seeing movement where we didn’t have traction before. People are deciding suddenly they need a reservation system to manage the flow of people. Perhaps they have had to cut staff during the pandemic and probably missed revenue projections. Thanks to its intuitive design, this system is meeting a myriad of online waiver and even other electronic document needs created by the current pandemic crisis.
Following is a Q&A with Kate Tucker, WaiverSign’s Business Development Manager, concerning this system’s dynamic flexibility.
What is integral to the platform that allows WaiverSign to be flexible for use beyond liability waivers?
WaiverSign is fully customizable. An example is the ability to offer clients check boxes and even the ability to ask a question where you can have several answers. It can be programmed where the user can just select one answer. I've seen this come into play with specific COVID waivers with business owners presenting COVID symptoms and asking their clients/customers to select any symptoms they've been exhibiting or if they've been exposed to someone with COVID.
Many spas, salons, estheticians and massage therapists have been converting their intake forms to digital to allow their clients to sign before their service. Each service like a facial or massage can have its own unique link. These links can be linked together within the WaiverSign application to produce one unique link for the client to sign so that the signing process can be efficient and easy.
Other common uses of the WaiverSign platform include rental agreements, facility use agreements, amenity agreements, damage release forms, and even consent forms for image use with photography or videography.
What are the more popular features of the platform now coming into play?
One feature that many are finding very useful right now is the "Event Management" feature of WaiverSign. This is allowing business owners to set up specific events, associate them with a date, even assign a coordinator. This has come into play with the hotels that we've set up for their wedding, party and conference business, or sports teams and leagues with practices or games at specific facilities. They are presenting both standard liability waivers and COVID-specific documents and then asking the guests to sign. The custom questions capability on forms is also being used very heavily right now.
How is it being used as a COVID screening tool?
The business owner is relaying COVID language and rules per their state and then asking people to check if they've been exposed or not, whether or not they are exhibiting symptoms, and ensuring they can abide by the COVID mitigation protocols that the organization has in place.
How is WaiverSign being used for photo releases?
Companies often have photographic consent forms or model release forms giving the business permission to use photos or videos of participants in their marketing materials. As this function is similar to a liability waiver (adults signing for themselves and on behalf of minors), the use of WaiverSign for photo releases is a perfect fit.
What are some other “surprises” as regard to applications that appear to be meeting COVID-driven needs?
We've had a nice uptick in large sport team organizations (baseball, soccer, lacrosse, softball) using WaiverSign to have their players agree to COVID statements and also about signing them before practices and tournaments to make sure that no one is exhibiting signs or has been exposed to COVID.
We've equally had an uptick in off-road ATV, UTV parks presenting COVID language to their riders and asking them agree to park terms with new social distancing rules.
We've also had several swim teams sign up to use WaiverSign for the same reasons as above.
Several large, private athletic clubs in Denver, CO; New York City and in Oregon are having their entire membership agree to new rules and policies pertaining to COVID and social distancing, acknowledged via WaiverSign.
What are some other surprising ways the WaiverSign platform is being used by cheerleading groups, personal trainers, salons/spas and others?
These segments of the business have been really strong for WaiverSign. We've seen Yoga, Pilates, Barre, Zumba and personal trainers taking their classes to an online environment during COVID and asking their students to sign waivers as they train from home. Cheerleading teams have had their athletes sign waivers for cheer competitions and training from home as well. Two of the cheerleading teams have also taken their company manuals online, having parents agree to the training regimen and COVID procedures. Salons have also taken it a step further to explain to their clients during the WaiverSign process what can be expected of the cut/color experience during COVID -- new rules about masks, sanitation, lack of magazines that will be available to read, no outside food or drink etc.
Have you had to “tweak” the platform to meet different demands not originally anticipated?
We've been rather fortunate that with the current flexibility of the system, it has worked very well for all these other needs.
Do these new uses change the way you are marketing WaiverSign?
We are certainly adapting our messaging to fit with all the new needs that have been coming up over the past few months. We've also been helping see the benefits of using a digital process as we all search for more "contactless" ways to do business right now. For example, WaiverSign can definitely help our clients make the waiver signing process contactless. Business owners can place the waiver link on their websites, send the link out in confirmation emails or texts and also tie the waiver to a QR code so that people can scan the QR code on their own mobile devices so that tablets don't have to be shared or cleaned between signatures during COVID. This can all happen before a service, practice or appointment, creating a seamless and stress-free experience for their client/customer.
Does Resmark Systems have another product in the works based on the changes and demand?
So far, we haven't needed to look at developing additional products as our current WaiverSign platform has been a great fit for most cases. With the added variety in industries, however, we are looking at the build out of some additional features and integrations with platforms that many of our clients use.

SALT LAKE CITY, UT, June 30, 2020 – In 14th century Nuremberg people in homes infected by the Black Plague were denied egress from their dwellings. This strategy kept the death count far lower in this German city than in the rest of Medieval Europe.
A strategy nearly seven centuries later to slow the course of COVID-19 is an iteration of this draconian measure. We’re asked to be responsible and to stay home. But as bars, beaches, sports events, and political rallies beckon, this isn’t happening and the pandemic is on restart.
What’s a public to do?
Enter Contact Tracing, a strategy whereby people are hired to play detective and follow COVID-19 leads. But this sleuthing is hindered by privacy concerns and dead ends.
However, in Salt Lake City, Utah, a company called WaiverSign has come up with a strategy that allows Contact Tracing to play sleuth digitally. It combines digital waivers with new contact tracing permissions to create the potential for almost instantaneous tracking once an infected contact is reported.
Here’s how.
When digital waivers are signed to allow people to participate in any kind of access or activity, these waivers automatically gather demographic and contact information of all participants.
In this same digital waiver process, businesses open to the public and events of all shapes and sizes can communicate in their electronic agreements the precautionary measures they’re taking against COVID-19 and ask participants to report back to them any positive test results following the event. The waiver, or other COVID-specific agreements, can also ask permission to provide contact information to health organizations for contact tracing purposes. These agreements can also give permission to communicate any potential exposure to others involved in the event.
“Using the WaiverSign platform for well-planned COVID-19 mitigation measures is a way that business and non-profit communities can help our country lessen the burden on an economy that hopes to recover,” said Brandon Lake, CEO of WaiverSign. “The WaiverSign process lends itself perfectly to these other measures. Companies can even create two agreements that the platform efficiently helps participants sign back to back. For example, one agreement might be a standard liability waiver and the other agreement could be specific to COVID and contact tracing.”
A WebMD story reported that one estimate of what it would cost to pay for a year all of the contact tracers needed to reopen the United States is $3.6 billion.
With appropriate and legal-advised wording, digital waivers or contact tracing agreements could give permission to business and events managers to communicate with followers before, during and after an event via email, phone or even social media. Communications can help attendees understand precautions, protocols and expectations regarding COVID-19.
Lake reported that Westin Hotels & Resorts recently signed up to use WaiverSign at several of their properties.
“One of their objectives was specifically around events such as conferences, weddings, and other large gatherings. Beyond protecting the company from liability related to COVID, this is an excellent opportunity to also use WaiverSign to collect event attendee data for contact tracing purposes,” he said.
“Ensuring that companies and event organizers have a plan to collect all participant information so that they can communicate with them is an essential part of any COVID mitigation plan - not only for contact tracing, but also to communicate with attendees regarding other critical information,” noted Lake.
