Personal Trainers Eagerly Adopt Digital Liability Waivers Through WaiverSign

Being cooped up by the pandemic may mean copping out on exercise. But spring brings the urge to take our bodies to task once again. A cadre of personal trainers stands ready to help with corporeal renovations.

For example, a team of seven personal trainers serves up to 40 clients daily at Wattage, a personal training facility in Chicago. Manager Maria Candia explains that training here is appointment-based, semi-private, or one-on-one.

“People want to move for an hour under the guidance of an experienced and certified trainer, someone who knows exactly what to do to help, even when outside of the gym,” she says.

Along with so many other businesses, Wattage was closed for a period of time in 2020, re-opening in June after establishing COVID-19 protocols to protect clients and staff. Among its protocols was the implementation of WaiverSign that provides a paperless path to obtaining signed online liability waivers from clients.

WaiverSign was an upgrade from the center’s traditional way of handing out paper waivers for clients to sign before they used the workout equipment. Now clients sign workout-related waivers, digitally produced, before coming to the center or affix their signatures at a kiosk right at the center. And they are asked to sign a COVID-19-related Code of Conduct, also digital, that pledges them to adhere to the center’s protocols.

With protocols and waivers in place, Candia is looking forward to the fair-weather days when clients can enjoy the fresh air coming in from the open garage-size doors.

“We have a great team who keep the gym super clean and organized. The fresh air makes clients and trainers more relaxed,” she says.

Waivers are long associated with such high-risk pursuits as sky diving, river rafting, and bungee jumping. But as reported in Money, June 9, 2020, “As Americans return to their favorite gyms, salons, and restaurants, waivers will be part and parcel of the experience…”

Signing WaiverSign’s Digital Waiver is Step 1 in Pay-to-Play Backyard Pool

SALT LAKE CITY, Feb. 24, 2021 – Ned Gilardino lives in Colorado. He’s a retired teacher enjoying one of his retirement assets, his home with mountain views and an 800-square-foot swimming pool. Last summer he realized that with the pandemic-driven closures of public swimming pools his own backyard amenity might be turned to profit. He arranged through Swimply.com to list his pool as available for single-party rent by the hour.

“People paid me, brought me wine to thank me, and were so grateful they had some place to go. The need is there,” he said.

One of his clients, an attorney, asked: “Where’s the waiver?” This prompted Gilardino’s search for a convenient, paper-free service that would protect him and his house. This summer all of his clients will be asked to log on to WaiverSign and sign a digital release of liability form prior to arrival.

As of early February 2021, he had already taken nearly 50 reservations for pool rentals between mid-May and end September. He’s curious to know who he’ll host this summer. Last year his clients ranged from young people training for water polo to a company using the pool for 150 hours of lifeguard training and to a crew shooting a music video. But most clients are families and friends.

Shannon Maloney, Front Desk Manager of the Manhattan Plaza Health Club in New York City, began using the online waiver system when the club was allowed to re-open following a pandemic shut-down. One of Shannon’s goals in securing WaiverSign is to minimize services that involve frequent touching of paper and pen.

RESMARK Systems Focuses On How to Help Tour Operators In Post-Pandemic World

SALT LAK CITY, UT, Nov 9, 2020 – Chip Broyles has his finger on the pulse of the tours and activities industry and what tour operators can be doing now to prepare for a post-pandemic future.

Broyles is Vice President of Client Success for RESMARK Systems in Salt Lake City, Utah. Along with much of the broader hospitality industry, many tour and activity operators throughout the world have been in freefall this year.

“We are preparing for the inevitable return in the coming months. Things will eventually return to pre-pandemic levels. We learned a lot with this pandemic about how to rethink tours, rethink social spacing and how to accommodate what’s going on in the world. Everything is not about COVID-19 but is a reality of what has affected tours and activities,” says Broyles.

Among the issues facing tour operators this year were:

●       Cancelled reservations including an almost total drop-off in international travel. Broyles says this is slowly coming back.

●       An unexpected demand on some tour operators to meet domestic requests in June, July and August. “A lot of people were pent up and wanted to get out. Those tour operators who could accommodate found themselves extremely busy. Some had more business than they could handle because of limited staff. They might be open but they might not have all of the guides who would be comfortable working in these times,” says Broyles.

●       Learning to push forward, plan ahead, clean house and get ready to be busy again. “We have no idea when this will happen. Things are happening slowly. Certain islands in the Caribbean are starting to open up,” he says.  “Now is still a great time to look at tightening things up. So often, tour operators have too many offerings, too many activities and tours.”

Broyles and his team are providing counsel on these and other issues to existing RESMARK clients and to others who aren’t yet on board.

“We’re seeing movement where we didn’t have traction before. People are deciding suddenly they need a reservation system to manage the flow of people. Perhaps they have had to cut staff during the pandemic and probably missed revenue projections. Resmark Systems’ WaiverSign Excels with Changing COVID Demands Thanks to Innate Flexibility

SALT LAKE CITY, UT, Aug. 13, 2020 – Demand for WaiverSign, Resmark Systems’ digital release of liability waiver application is surging to meet more varied requests than its founders in 2013 might have envisioned initially.

Thanks to its intuitive design, this system is meeting a myriad of online waiver and even other electronic document needs created by the current pandemic crisis.

Following is a Q&A with Kate Tucker, WaiverSign’s Business Development Manager, concerning this system’s dynamic flexibility.

What is integral to the platform that allows WaiverSign to be flexible for use beyond liability waivers?

WaiverSign is fully customizable. An example is the ability to offer clients check boxes and even the ability to ask a question where you can have several answers. It can be programmed where the user can just select one answer. I've seen this come into play with specific COVID waivers with business owners presenting COVID symptoms and asking their clients/customers to select any symptoms they've been exhibiting or if they've been exposed to someone with COVID.

Many spas, salons, estheticians and massage therapists have been converting their intake forms to digital to allow their clients to sign before their service. Each service like a facial or massage can have its own unique link. These links can be linked together within the WaiverSign application to produce one unique link for the client to sign so that the signing process can be efficient and easy.

Other common uses of the WaiverSign platform include rental agreements, facility use agreements, amenity agreements, damage release forms, and even consent forms for image use with photography or videography.

What are the more popular features of the platform now coming into play?

One feature that many are finding very useful right now is the "Event Management" feature of WaiverSign. This is allowing business owners to set up specific events, associate them with a date, even assign a coordinator. This has come into play with the hotels that we've set up for their wedding, party and conference business, or sports teams and leagues with practices or games at specific facilities. They are presenting both standard liability waivers and COVID-specific documents and then asking the guests to sign. The custom questions capability on forms is also being used very heavily right now.

How is it being used as a COVID screening tool?

The business owner is relaying COVID language and rules per their state and then asking people to check if they've been exposed or not, whether or not they are exhibiting symptoms, and ensuring they can abide by the COVID mitigation protocols that the organization has in place.

How is WaiverSign being used for photo releases?

Companies often have photographic consent forms or model release forms giving the business permission to use photos or videos of participants in their marketing materials. As this function is similar to a liability waiver (adults signing for themselves and on behalf of minors), the use of WaiverSign for photo releases is a perfect fit.

What are some other “surprises” as regard to applications that appear to be meeting COVID-driven needs?

We've had a nice uptick in large sport team organizations (baseball, soccer, lacrosse, softball) using WaiverSign to have their players agree to COVID statements and also about signing them before practices and tournaments to make sure that no one is exhibiting signs or has been exposed to COVID.

We've equally had an uptick in off-road ATV, UTV parks presenting COVID language to their riders and asking them agree to park terms with new social distancing rules.

We've also had several swim teams sign up to use WaiverSign for the same reasons as above.

Several large, private athletic clubs in Denver, CO; New York City and in Oregon are having their entire membership agree to new rules and policies pertaining to COVID and social distancing, acknowledged via WaiverSign.

What are some other surprising ways the WaiverSign platform is being used by cheerleading groups, personal trainers, salons/spas and others?

These segments of the business have been really strong for WaiverSign. We've seen Yoga, Pilates, Barre, Zumba and personal trainers taking their classes to an online environment during COVID and asking their students to sign waivers as they train from home. Cheerleading teams have had their athletes sign waivers for cheer competitions and training from home as well. Two of the cheerleading teams have also taken their company manuals online, having parents agree to the training regimen and COVID procedures. Salons have also taken it a step further to explain to their clients during the WaiverSign process what can be expected of the cut/color experience during COVID -- new rules about masks, sanitation, lack of magazines that will be available to read, no outside food or drink etc.

Have you had to “tweak” the platform to meet different demands not originally anticipated?           

We've been rather fortunate that with the current flexibility of the system, it has worked very well for all these other needs.

Do these new uses change the way you are marketing WaiverSign?           

We are certainly adapting our messaging to fit with all the new needs that have been coming up over the past few months. We've also been helping see the benefits of using a digital process as we all search for more "contactless" ways to do business right now. For example, WaiverSign can definitely help our clients make the waiver signing process contactless. Business owners can place the waiver link on their websites, send the link out in confirmation emails or texts and also tie the waiver to a QR code so that people can scan the QR code on their own mobile devices so that tablets don't have to be shared or cleaned between signatures during COVID. This can all happen before a service, practice or appointment, creating a seamless and stress-free experience for their client/customer.

Does Resmark Systems have another product in the works based on the changes and demand?

So far, we haven't needed to look at developing additional products as our current WaiverSign platform has been a great fit for most cases. With the added variety in industries, however, we are looking at the build out of some additional features and integrations with platforms that many of our clients use.

Digital Waiver Systems Emerging as Key Player in Pandemic Contact Tracing

SALT LAKE CITY, UT, June 30, 2020 – In 14th century Nuremberg people in homes infected by the Black Plague were denied egress from their dwellings. This strategy kept the death count far lower in this German city than in the rest of Medieval Europe.

A strategy nearly seven centuries later to slow the course of COVID-19 is an iteration of this draconian measure. We’re asked to be responsible and to stay home. But as bars, beaches, sports events, and political rallies beckon, this isn’t happening and the pandemic is on restart.

What’s a public to do?

Enter Contact Tracing, a strategy whereby people are hired to play detective and follow COVID-19 leads. But this sleuthing is hindered by privacy concerns and dead ends.

However, in Salt Lake City, Utah, a company called WaiverSign has come up with a strategy that allows Contact Tracing to play sleuth digitally. It combines digital waivers with new contact tracing permissions to create the potential for almost instantaneous tracking once an infected contact is reported.

Here’s how.

When digital waivers are signed to allow people to participate in any kind of access or activity, these waivers automatically gather demographic and contact information of all participants.

In this same digital waiver process, businesses open to the public and events of all shapes and sizes can communicate in their electronic agreements the precautionary measures they’re taking against COVID-19 and ask participants to report back to them any positive test results following the event. The waiver, or other COVID-specific agreements, can also ask permission to provide contact information to health organizations for contact tracing purposes. These agreements can also give permission to communicate any potential exposure to others involved in the event.

Lake reported that Westin Hotels & Resorts recently signed up to use WaiverSign at several of their properties.

Online Liability Waiver Software Seeing Record Sign-on Spike in Time of COVID-19 Pandemic

SALT LAKE CITY, June 23, 2020 – Who’s afraid of the Big Bad Wolf?

“I am,” says Disney World, as do beauty salons and fitness centers and even the New York Stock Exchange.

Just who is the Big Bad Wolf?

Collectively these are clients and customers who may be inclined to sue by alleging they contracted COVID-19 on the premises of businesses they patronize.

The result is that to indulge in retail therapy, dine out, sweat in a gym or squeal on an amusement park ride, you may be asked to sign on the dotted line. And if you choose not to sign, you may not be able to get through the door.

These aren’t signatures on credit cards, rather on legal documents called waivers.

Waivers are long associated with such high-risk pursuits as sky diving and bungee jumping. But as reported in Money, June 9, “As Americans return to their favorite gyms, salons and restaurants, waivers will be part and parcel of the experience …”

Employees may also be asked to sign waivers, noted The Philadelphia Inquirer in a June 8 article suggesting that contracting COVID-19 on the job may fall into the category of an occupational disease, thus making employers liable.

By requiring signed waivers, businesses are not asking customers and staff, in Dante’s words, to “abandon hope, all ye who enter here”. Rather they want these participants to commit by signature their understanding that this pandemic puts at risk all who choose to enter a locale. By acknowledging in advance the risks, the participant assumes responsibility for a decision to partake; and businesses adhering to disease-mitigation protocols may steer clear of liability for illness-related claims.

In fact, the word “waiver” now seems to be entering the pandemic lexicon of masks, hand washing and social distancing.

From May 1 to mid-June, 2020, one software company has seen a massive spike in signups for its digital liability waiver application services. WaiverSign was up 169% over the same period in 2019. Already in June, signups are more than twice what they were on the same date in May.

Fortunately, having facilitated the signing and storage of hundreds of thousands of waivers for major college basketball events, the San Francisco 49ers, YMCA, and other large organizations, WaiverSign was prepared for the volume increase.

“A lot of changes are happening. In addition to creating and implementing solid COVID-19 mitigation and operations plans, companies are adding the risks of COVID-19 and other illnesses to their liability waivers,” said Brandon Lake, CEO of WaiverSign headquartered in Salt Lake City, Utah. “And part of those mitigation plans for nearly every company is to allow their patrons to sign waivers digitally - on their own devices.”

However, minimizing the passing of pens and paper isn’t the only benefit to online waivers. This event management featurecan identify and locate groups of people who signed a particular waiver or set of waivers for a certain activity on a specific day.

Chun Wright of the Law Office of Chun T. Wright in Washington, DC, said that wording around privacy notices and consent could be written into waivers that would allow event lists to serve as a contact tracers.

“Potentially this tool could give event managers and anyone who operates a business the ability to notify attendees who have been in contact with anyone at the event or on the premises who has tested positive,” she said.

“Ensuring that companies and event organizers have a plan to collect all participant information so that they can communicate with them is an essential part of any COVID mitigation plan - not only for contact tracing, but also to communicate with attendees regarding other critical information,” noted Lake. Helping people feel comfortable while attending an event will be a marketing concern moving forward. Chun Wright, Law Office of Chun T. Wright in Washington, DC, said waivers are going to be “front and center” in the next few weeks as companies begin to get back into business. Why? Because waivers can help reduce liability and ultimate financial loss that may occur if a guest is injured, or in the case of COVID-19, becomes ill on a company’s watch.

A signed waiver indicates that a customer had advance warning of the risks of participating. This signed waiver is a communications tool that shows assumption of risk and that somebody released the company from the right to sue. It also can be a screening process, eliminating someone who may not be comfortable currently participating in such activities as axe-throwing, rock climbing or guided kayaking.

The webinar also addressed the need to mitigate the possible risks facing a guest and how to limit liability exposure by defining and implementing a solid operations plan. Protocols, screening, training and communication are all vital elements, as suggested by panelist Leah Corrigan, founder of the Recreation Law Center in Jackson Hole, Wyoming.

Flagstaff Snow Park Announces Successful Integration with Resmark and WaiverSign to Manage Bookings and Handle Liability Waivers

SALT LAKE CITY, UT, Feb 5, 2020 – One of the snowiest cities in the West is Flagstaff, Arizona. In this urban center alone are over 72,000 people looking for inexpensive ways to enjoy winter.

Jonathan Allen created Flagstaff Snow Park in 2016 to address this need. He estimates in the winter of 2019/2020 that up to 70,000 people will purchase tickets for a tube and sliding space on a slope.

“We’re at a 7,000-foot elevation at the edge of a reliable snow line. For around 10 weeks people flock from Phoenix and all around the desert to fly down our hills, to warm their feet above our open fire pits, to roast marshmallows and even build snowmen. The main thing is that families are playing outside together,” underscores Allen.

Rolling 70,000 people through traditional onsite ticket windows could crush an operation that runs only from mid-December to early March. Allen calculates that onsite staffing needs would be enormous and customer satisfaction challenged by long waits in lines to purchase tickets.

Thanks to technology there’s an easy solution that Allen began implementing in November 2019. Customers can reserve tickets for tubes and slope space digitally from two to five days in advance of arrival. Since mid-December 2019 through early January, upwards of 42,000 clients have used Resmark Systems’ online booking system for tubing reservations.

When clients reach Flagstaff Snow Park, there are service windows for these pre-purchased tickets. At the end of December, the operation installed three kiosks that assist the ticket flow. Those without reservations purchase their tickets at other windows, perhaps running the risk of being turned away if the Park’s occupancy has reached its limit for the day.

This system, notes Allen, works “really smoothly.” Information on pre-purchase tickets is held at specific windows for speedy processing.  Even on busiest days there are never more than 10 to 15 in a pre-purchase line at a time. This system, which works especially well for groups who have pre-purchased, eliminates the one-time lines of 50 or more people waiting to check in.

Allen envisions a near future with two or three kiosks that allow on-site self-check ins for pre-reserved tickets.

All tickets, reserved or not, come with a liability waiver. At the time the reservation is made, people booking online through Resmark are reminded to fill out a digital waiver, thanks to an integrated electronic waiver system called WaiverSign.

“This is really beneficial because Resmark can track who has and who has not completed their waivers,” notes Allen. He is hoping in the near future to add a QR code that will link customers’ handheld devices to the waiver signing website.

Those making purchases at a ticket window must also fill out liability waivers through WaiverSign. This digital process eliminates old-fashioned paper liability waivers.
